TERMS AND CONDITIONS OF HOLIDAY RENTAL ON CONFIRMATION OF BOOKING
GUESTS AUTOMATICALLY AGREE TO THE FOLLOWING CONDITIONS.

JAMES’ PLACES @ THE BRECON BEACONS

These booking terms ('Booking Terms') are between the hotel, guesthouse or self-catering unit (referred to as ‘We’/’Us’/’Our’) named under the ‘Reservation Confirmed with section of the Booking confirmation ('Booking Confirmation') and the person or legal entity making the Booking (‘You/Your/Guest/Guests’). These Booking Terms are for the provision of accommodation services ('Booking(s)') by Us to You. These Booking Terms are governed by English law and apply to all Bookings. By making a Booking You are deemed to accept and be bound by these Booking Terms. 

BOOKINGS

Bookings are made and a contract between You and Us comes into effect when We accept a reservation from You. We will accept a reservation when We have confirmed Your reservation and received either: (i) full payment of the total price; or (ii) payment of a deposit equivalent to the value of the first night stay; (iii) any other amount We have specified at the time of Your booking. Where a deposit or any other amount that is less than the total value of the stay is paid, the balance will be paid by You directly to Us, on either check-in or check-out or at an earlier date if so requested by direct communication between You and Us. You must be able to enter into a legally binding contract and be over 25 years of age to make a Booking. Bookings must be paid for using a valid credit or debit card or any other payment type specified. When Your Booking is confirmed, a reservation number is given. This number must be retained for access to Your Booking details if cancellation or amendment is necessary. You will need to quote this reservation number when contacting Us. 

PAYMENT INFORMATION

When You make a payment using a credit card, We (or Our parent company or Our trading name if different) will be displayed as the merchant of record. 


All prices include VAT where applicable at the current rate. Prices are per room per night. Prices do not include other costs You may choose to incur during Your stay (unless otherwise stated). Prices quoted are correct (unless a pricing error occurs) only for the specific number of guests, dates, nights and rooms shown. 


Full payment is required by 3pm 7 days prior to arrival. The total amount payable to confirm Your Booking is quoted in Your Booking Confirmation and will be charged to Your credit or debit card or any other payment type offered at the time of Booking or on check-in.  Your card statement will display Us (or Our parent company or Our trading name if different) as the merchant of record. All additional goods and services purchased during Your stay must be paid in full via the agreed payment method. 


We have the right to cancel and issue a refund to You if You do not agree to the terms and conditions as set out. 

DAMAGE DEPOSIT

A separate breakages deposit of £1000 is required 2 days prior to the Your stay. If the booking is less than 2 days in advance the damage deposit is required at the time of booking.


The breakages deposit will be refunded within 7 days of departure if there has been no infringement of items related to the damage deposit.

 
The house manager will conduct a thorough check after a Your departure. 


Payment and breakages deposit will be collected via your booking channel eg Booking.com, Airbnb etc etc. 

CANCELLATION & DAMAGE DEPOSIT REQUIREMENTS 

There is no cancellation charge providing the cancellation is received before 3pm 7 days prior to your arrival date. The cancellation charge is 100% of the booking cost if the cancellation is received 3pm or after 7 days prior to your arrival date.


Should You change the number of guests, dates, room nights or room type (“Amendment”), then the prices are subject to change.  Should You request an Amendment and should We not be in a position to accommodate Your Amendment, Your Booking will be cancelled and a full refund given to You provided that such cancellation occurs on or before the Cancellation Deadline, failing which the terms described in this Cancellation clause shall apply.


The property is on a private residential lane. Out of courtesy for the other residents quiet time is from 10pm and 8am. For this reason, If We do receive a complaint related to noise or inappropriate behaviour from one of our neighbours £250 will be taken from the breakages deposit. 


Dogs are allowed when pre-arranged. If You have arranged to bring your dog please ensure they are not allowed on the furniture or upstairs. We also ask that you clean any dog mess Your dog may have made in the garden. If this is not completed £50 will be deducted from your damage deposit.


Do not smoke anywhere in the house. If this is proven to have happened, Your full damage deposit will be automatically withheld for dry cleaning purposes. 


£200 will automatically be deducted from the breakages deposit if the house is not left as clean and tidy as it was found, this includes washing up all your dishes, cups, and putting back into cupboards i.e. please leave as closely as you found the house. 


We are keen to help save our environment and it is a legal requirement to recycle in Wales. £250 will automatically be deducted from the breakages deposit if the recycling is not completed. The bins inside the property have been marked up to identify which category they are for. There is a food waste bin on the kitchen windowsill. Once you are ready to leave your rubbish should be separated into glass, cardboard, hard plastic/tin, paper, food and the rest is landfill. Each category should then be placed into a separate waste container that can be found outside the garden shed. 


Check in must take place after 4pm and check out at 10am. You must adhere to these times especially during this pandemic. £100 is taken from your breakages deposit if you do not check out by 10am as we now need additional time to clean to the COVID cleaning regulations.


Any type of breakages will be charged against your damage deposit. 


We have the right to cancel and issue a refund to You if You do not agree to the terms and conditions as set out. 

AVAILABILITY

In the rare case that We are unable to accommodate You as per Your Booking, You will be offered alternate accommodation by Us, if available and if there is a difference in the Price, You will be liable for the price differential. If the differential is less than the original value of Your Booking a refund of the difference will be made to You. 

CHECKING IN/OUT 

Check in must take place after 4pm and check out at 10am. You must adhere to these times especially during this pandemic. 


The lead booking person must check in or provide clear contact information for the person checking in. We will need names and contact details for all Your guests staying at the property.


Please note we  now have to be much more thorough with changeovers between guests departing and arriving so later check outs are not possible. 

LIABILITY 

Other than for death or personal injury caused by Our negligence or fraudulent misrepresentation, Our total liability to You is limited to the price of the Booking and in no circumstances will We be responsible to You for any indirect or special damages.

 
We will not be liable for failure to provide the services to the extent that the failure is caused by any factor beyond Our reasonable control. You are responsible for any damage or loss caused to Us, including any damage to Our property by Your act, omission, default or neglect and You agree to indemnify Us and You agree to pay Us on demand the amount reasonably required to make good or remedy any such damage or loss. Further, we reserve the right to terminate Your Booking immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to Our other guests.

GENERAL HOUSE RULES AND INFORMATION

The overall accommodation price is for 4 bedrooms that will sleep 8 people comfortably.

The person who is named as hiring the property is responsible for actions of all persons entering throughout the duration of the hire period. 


Please do not park outside the adjoining property out of courtesy for other residents in the lane. 


Please do not put cups or glasses onto the furniture – please use coasters. 


Any marks on furniture will be charged. 


Any type of breakages will be charged against your deposit. 


Any items, including ornaments, albums, c.d’s, d.v.d’s, games, kitchen equipment etc. are checked against our inventory. If anything is found missing or damaged after your departure, the cost of replacing, as a whole will be charged. 


Bookings cannot be accepted by any person under 25. No hen or stags parties are permitted at the property.


We take no responsibility of excessive weather conditions causing inability to travel to the house. 


The owner reserves the right to decline any booking or refuse to hand over the key to any person who has not complied with the booking conditions. 


The person checking in must be the same as the person who is named on the booking. If not the house manager has the right to refuse entry unless agreed prior to check in with the owner/manager. 


Children should not be allowed in the jacuzzi and if You choose, they must always be supervised by their parents. 


Shoes must be removed when entering the property. 


Please do not alter/tamper with heat settings this is done remotely. If you have any issue with heating during your stay please contact us. The house rent includes heating, gas and electricity. 


Hair dryers are provided. Iron and ironing board are provided. 


House is a private home with extremely sentimental and in some cases very valuable items. Please ensure that items are not moved, damaged or taken during your stay.

DATA PROTECTION

We will process the information You provide to Us in accordance with the relevant data protection legislation.  Your personal data may be transferred to eviivo Limited (Registered Office 154 Pentonville Road, London, N1 9JE Company Number: 5002392) including where necessary its subsidiaries outside of the EU.  By making a Booking, You consent to this processing of information as described above and the transfer of Your information to our software provider: eviivo Limited.  

JAMES’ PLACES @ BIKE PARK WALES & THE BRECON BEACONS

If your vehicle is parked on land belonging to Us it is parked at Your own risk.

Dogs are allowed at some of Our properties when pre-arranged. If You have arranged to bring your dog please ensure they are not allowed on the furniture or upstairs (where relevant). We also ask that you clean any dog mess Your dog may have made in the garden or outdoor terrace (where relevant). 


Please do not smoke anywhere in the property. If there is evidence of smoking we will charge a £200 cleaning fee. 


Please could you leave the property as closely as you found it. 


We are keen to help save our environment and it is a legal requirement to recycle in Wales. Bins will have been supplied within the property to allow you to recycle. Bins are also provided outside to move your recycled items to prior to leaving the property.


Check in must take place after 3pm and check out at 10am. You must adhere to these times especially during this pandemic.

We the right to cancel and issue a refund to You if You do not agree to the terms and conditions as set out. 

AVAILABILITY

In the rare case that We are unable to accommodate You as per Your Booking, You will be offered alternate accommodation by Us, if available and if there is a difference in the Price, You will be liable for the price differential. If the differential is less than the original value of Your Booking a refund of the difference will be made to You. 

CHECKING IN/OUT 

Check in must take place after 3pm and check out at 10am. You must adhere to these times especially during this pandemic. 


The lead booking person must check in or provide clear contact information for the person checking in. We will need names and contact details for all Your guests staying at the property.


Please note we  now have to be much more thorough with changeovers between guests departing and arriving so later check outs are not possible. 

LIABILITY 

Other than for death or personal injury caused by Our negligence or fraudulent misrepresentation, Our total liability to You is limited to the price of the Booking and in no circumstances will We be responsible to You for any indirect or special damages. 


We will not be liable for failure to provide the services to the extent that the failure is caused by any factor beyond Our reasonable control. You are responsible for any damage or loss caused to Us, including any damage to Our property by Your act, omission, default or neglect and You agree to indemnify Us and You agree to pay Us on demand the amount reasonably required to make good or remedy any such damage or loss. Further, we reserve the right to terminate Your Booking.
Immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to Our other guests.
If your vehicle is parked on land belonging to Us it is parked at Your own risk.

GENERAL HOUSE RULES AND INFORMATION

The person who is named as hiring the property is responsible for actions of all persons entering throughout the duration of the hire period. 


Dogs are allowed at some of Our properties when pre-arranged. If You have arranged to bring your dog please ensure they are not allowed on the furniture or upstairs (where relevant). We also ask that you clean any dog mess Your dog may have made in the garden or outdoor terrace (where relevant). 


Please do not smoke anywhere in the property. If there is evidence of smoking we will charge a £200 cleaning fee. 


Please could you leave the property as closely as you found it. 


We are keen to help save our environment and it is a legal requirement to recycle in Wales. Bins will have been supplied within the property to allow you to recycle. Bins are also provided outside to move your recycled items to prior to leaving the property.

Please do not put cups or glasses onto the furniture – please use coasters. 


Bookings cannot be accepted by any person under 18. No hen or stags parties are permitted at the property.


We take no responsibility of excessive weather conditions causing inability to travel to the house. 


The person checking in must be the same as the person who is named on the booking. If not the house manager has the right to refuse entry unless agreed prior to check in with the owner/manager. 


Hair dryers are provided. Iron and ironing board are provided. 

DATA PROTECTION

We will process the information You provide to Us in accordance with the relevant data protection legislation.  Your personal data may be transferred to eviivo Limited (Registered Office 154 Pentonville Road, London, N1 9JE Company Number: 5002392) including where necessary its subsidiaries outside of the EU.  By making a Booking, You consent to this processing of information as described above and the transfer of Your information to our software provider: eviivo Limited.
